HathiTrust was heartened today by Judge Leval's ruling in Authors Guild v. Google. The court's opinion aligns with the Second Circuit's earlier decision in the now-resolved case filed by the Authors Guild against HathiTrust, as well as a long line of cases stretching back a quarter of a century to the US Supreme Court's opinion in Campbell v. Acuff-Rose.
"This decision appears to resolve any questions about the legality of digitization for a broad array of uses that benefit members of the public and the authors of published works,” said Executive Director Mike Furlough. “We continue to focus our full attention on initiatives that transform how libraries collect, manage, preserve, and provide access to the record of human knowledge with full respect for the law."
